What are the essential parts of a trademark application?
The entire trademark application must be filled out accurately. If it is incomplete or completed incorrectly, the application will be declined and the process delayed, usually by months. Key elements of the application include:
- Name of the applicant - an individual, corporation, partnership or other legal entity
- Name and address for correspondence - the applicant or the applicant's legal representative
- Clear drawing of the mark - once filed you cannot make material changes
- Listing of the goods or services - once filed only clarifications are allowed
- Filing fee for at least one class of goods or services
- Basis for Filing - current use of the mark in commerce or the intent to use the mark in commerce in the future
- Specimen of use - an actual example of how the mark is being used in connection with the classes of goods/services
